Terms of Use

These Terms govern your use of Fabricum (the «App») on iOS, provided by DGTL TECH LLC («Company», «we», «us»), a Wyoming limited liability company located at 30 N Gould St Ste #46339, Sheridan, WY 82801, USA. By installing or using the App you agree to these Terms.

1. The Service

Fabricum is an informational tool that compares a photograph of a Hermès silk scarf with our Curated Research Archive of known limited editions and points out features that distinguish each limited edition from the regular series. The result is informational only and does not constitute authoritative authentication. Final authentication of a luxury item requires inspection by Hermès or an accredited expert.

2. Not affiliated with Hermès

Fabricum is an independent project. It is not affiliated with, associated with, authorized, endorsed or sponsored by, or in any way officially connected with Hermès International S.C.A., Hermès Sellier, or any of their subsidiaries or affiliates. All design names, motifs and trademarks remain the property of their respective owners. References to Hermès products are made solely for descriptive and identification purposes (nominative fair use).

3. Free scans, subscriptions and packs

• New users receive three (3) free scans.
• Auto-renewable subscriptions — Basic, Plus and Premium — unlock access to different sections of the Research Archive (edition tiers), the news digest, and a monthly scan allowance; tier details are described in the App. Subscriptions renew automatically through your Apple ID until cancelled; manage or cancel them in your App Store subscription settings. Cancellation takes effect at the end of the current billing period.
• One-time consumable scan packs are also available. Pack credits never expire and stack across purchases.
• Exact prices and terms of every product are shown in the App at checkout; local pricing may vary.
• Purchases, renewals and refunds are processed by Apple and governed by Apple's standard policies. If Apple revokes a transaction, the corresponding credits or entitlements are removed from your account.
• Promotional bonus credits or gift subscriptions may be granted at our discretion; they carry no cash value.

4. Acceptable use

You agree not to:

• Use the App to mislead a buyer or seller about authenticity.
• Reverse-engineer, decompile, or attempt to bypass the recognition quota.
• Use the App for automated, large-scale, or commercial scanning beyond personal use.
• Submit content that is unlawful, infringing, or contains malware.

We may suspend access for users who violate these rules.

5. Intellectual property

• Fabricum. The App, its software and design, the descriptive texts, annotations and photographs created by us, and the selection, structure and arrangement of the Research Archive as a database are owned by or licensed to Fabricum. You receive a limited, non-exclusive, non-transferable licence to use this content for personal, non-commercial purposes within the App. Bulk extraction, scraping or republication of the Archive is not permitted.
• Hermès. The designs and trademarks of Hermès remain the property of Hermès International. They are referenced solely for descriptive and identification purposes; no affiliation is implied. Some Archive entries quote short excerpts from Hermès' official release descriptions for descriptive and reference purposes; these texts remain the property of their rights holders.
• Reference photographs. Photographs in the Research Archive come from several sources: taken by us; contributed by collectors and community members under a non-exclusive licence; or sourced from publicly available materials (auction listings, vintage marketplaces, the manufacturer's public materials) and used for descriptive, research and educational purposes to the extent permitted by fair-use and equivalent doctrines.
• Your contributions. When you add a scarf and choose to share it with the community, you retain ownership of your photos and notes and grant Fabricum a non-exclusive, worldwide, royalty-free licence to host, display and use them within the Archive. You confirm that you hold the rights to the content you upload.
• Rights holders. We respect the rights of photographers and other rights holders and are always open to dialogue. If you believe any material in the Archive is used improperly, write to us at — we will review your request promptly and, where justified, credit, replace or remove the material.

6. Disclaimer

THE APP IS PROVIDED «AS IS» WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF THE RESEARCH ARCHIVE OR RECOGNITION RESULTS. DO NOT RELY ON THE APP'S RESULTS AS A SOLE BASIS FOR PURCHASING, SELLING, OR INSURING A LUXURY ITEM.

7. Limitation of liability

To the maximum extent permitted by law, Fabricum shall not be liable for any indirect, incidental, consequential or special damages arising from the use of the App. Total liability shall not exceed the amount you paid us through the App during the 12 months preceding the claim.

8. Termination

You may stop using the App at any time by deleting it. We may terminate or suspend access for breach of these Terms. Subscription cancellation is handled through your Apple ID.

9. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute shall be resolved in courts located in Sheridan County, Wyoming.

10. Changes

We may update these Terms. Continued use of the App after changes constitutes acceptance.
